Today the 9th Circuit Court of Appeals issued an orderthat instructs the government to declare within 10 days
whether or not it will appeal last week’s ruling regarding
“Don’t Ask, Don’t Tell” (DADT). In other words the Obama
administration Department of Justice needs to stop dodging
the question & make clear whether it intends to continue
defending the constitutionality of 'Don't Ask, Don't Tell.'

“The Court of Appeals for the Ninth Circuit is correctly
pressing the Department of Justice & Department of
Defense on whether or not they intend to defend the
constitutionality of ‘Don’t Ask, Don’t Tell.’ It is our hope
they will not continue to do so, & we will soon have
finality with certification & repeal.” Remember that despite
Obama signing the bill authorizing repeal of DADT, it is
still unsafe for service members to come out until 60 days
after certification by President Obama, Secretary Panetta

After months of doublespeak from the Obama administration's lawyers, the Ninth Circuit Court of Appeals has demanded that the Department of Justice clarify its position on the constitutionality of 'Don't Ask, Don't Tell. Log Cabin Republicans have been fighting against 'Don't Ask, Don't Tell' in court for years. The ruling in Log Cabin Republicans v. United States set an important precedent by showing that discrimination against gay and lesbian Americans is unconstitutional. The ruling in LCR v. US is worth defending as long as "Don't Ask, Don't Tell" remains on the books.
