Prop 8 Has Court Date Sept 6th

Here we go again totally torturing our California LGBT community as a date has been set for the next hearing in the Prop 8 case according to the American Foundation for Equal Rights. The Supreme Court of California has announced that the hearing date for Perry v. Brown will be on Tuesday, September 6th at 10AM. This date is the very first day of the court’s fall calendar. The court will hear oral arguments on a question of whether under state law proponents of initiatives have standing to defend their initiatives when they are challenged in court. The question was certified to them by the U.S. Court of Appeals for the Ninth Circuit earlier this year. With New York passage of gay marriage hopefully this will finally be resolved. Gay Ally Lady Gaga to be Ordained…

Lady Gaga says she wants to be ordained as a minister to marry her gay friends. The singer & fierce gay activist said that she wants to be a minister now that marriage equality was passed in New York. Gaga said she was 'thrilled' that gay marriage in New York has now been legalized, "I just think for myself as an activist it's always about being positive and honoring & being excited about the small steps that are taken toward equality. I'm excited about the things that are happening & I'm going to continue to band together with all my friends & with my generation to continue to fight for our rights." New Survey on Gay Work Discrimination

As gay civil rights advance in the military & same-gender marriage becomes legal in New York, the workplace still presents major discrimination for our LGBT community. A new survey by the Williams Institute report that 38% of lesbian, gay & bisexual employees who are out at work report being harassed because of their sexual orientation. More than 1/3 surveyed said they were not out to any colleagues at work. Surveys that focus specifically on transgender workers in recent years have found even greater employment discrimination. A 2011 study found that 78% of trans employees had reported at least one form of harassment on the job with almost 1/2 saying they'd experienced discrimination in hiring, & promotion. We need to focus on passing ENDA (the Employment Non-Discrimination Act) in 2012!! Congrats to New York Gay Newlyweds

Sunday thousands of gay & lesbian New Yorkers said "I do" as the Empire State became the 6th state to embrace gay marriage in the USA. This is definitely a game-changer following Massachusetts, Connecticut, Iowa, New Hampshire, Vermont & the District of Columbia where gay marriage is the law. The state law signed June 24th by Governor Andrew Cuomo went into effect as hundreds of couples statewide tied the knot, including 823 in New York City alone. This sends a clear message to Washington that it's time to push for change to federal laws as Obama endorses the Respect for Marriage Act, a bill to repeal the discriminatory Defense of Marriage Act that denies federal rights & protections to all legally married same-gender couples. “Don’t Ask, Don’t Tell” Almost Gone

Amy Winehouse Hacked To Death By The Tabloids...
Finally President Obama & our military service chiefs
certified the repeal of "Don't Ask, Don't Tell" today.
In 60 days it will be done. This week Obama also
endorsed a bill to repeal DOMA (Defense of Marriage
Act) the discriminatory law that forces the federal
government to ignore the rights of those in gay
marriages, even those performed in states where
gay marriage is legal. The New York Times has said
it "ranks with the most overtly discriminatory laws
in the nation's history." Speaking of New York, Sunday
gay marriage will start in that state. This is becoming
a huge month for LGBT civil rights. Let’s keep the

The Slow Death of “Don’t Ask, Don’t Tell”

According to the White House Obama is scheduled to
meet with Secretary of Defense Panetta & Admiral
Mullen shortly before 3P in the Oval Office today to
finally signoff on the certification that will end “Don’t
Ask, Don’t Tell”. Once all 3 sign it will take 60 days
before it goes into effect. Last week the 9th Federal
Court of Appeals compromised with the Obama
administration on their ruling stating that though
our gay & lesbian military cannot be fired during the
certification process gays & lesbians could not enlist
in the military until after the 60 day certification.

Don’t Tell Me.” Paula states, “To have access to the NPR
audience is pretty darn fun. They’re smart. They’re well-
informed. Not that I fall into either of those categories,
by the way. Less & less so as I grow older, in fact.”
She adds her appearances on NPR actually improve her

New Federal Bill Will Kill DOMA

Today the Senate will hold the first hearing on The
Respect for Marriage Act which will repeal DOMA
(Defense of Marriage Act). This bill will finally grant
our LGBT community access to federal rights &
protections that come with marriage in a state where
gay marriages is legal. “The president has long called
for a legislative repeal of the so-called Defense of
Marriage Act, which continues to have a real impact
on the lives of real people --our families, friends &
neighbors,” said Jay Carney, White House press
secretary. “He is proud to support The Respect for
Marriage Act, introduced by Senator Feinstein &
Congressman Nadler, which would take DOMA off
the books once & for all. This legislation would
uphold the principle that the federal government
should not deny gay & lesbian couples the same
rights & legal protections as straight couples.”
Of course this is great news but we're looking at
years before it goes into effect if passed. Just look
at how long we continue to wait for Don’t Ask,
Don’t Tell to be certified after its December repeal.

Openly Gay New Federal Judge

J. Paul Oetken was confirmed by the U.S. Senate by
a vote of 80 to 13 to become the first openly gay man
to serve on the federal bench. Obama nominated him
for the bench in January on the recommendation of
Sen. Charles Schumer of New York. Schumer said that
Oetken brought “diversity,” which he called a “bonus”
in addition to attributes of “excellence & moderation.”
Oetken will join U.S. District Judge Deborah Batts on
the U.S. District Court for the Southern District of New
York. Judge Batts was appointed during the Clinton
administration is the first openly LGBT person to sit
on a federal court. Obama also has nominated Alison
Nathan an out lesbian, for a judgeship in the Southern
District of New York, also on recommendation from
Schumer. Her confirmation awaits a vote in the full
Senate after a hearing last month. Edmund Dumont,
who is gay, has been nominated by Obama to serve as
an appellate judge on the U.S. court of appeals for the
federal circuit but his nomination still awaits a hearing.
Now if the closeted federal & higher court judges would
just bite the bullet & come OUT…:)

“Don’t Ask, Don’t Tell” Schizophrenia

Update: The Federal Court ruled Friday that there will
be a cease firing of gay & lesbian service members
but
if you’re gay & want to openly enlist, that’s not
going to
be allowed for now…..

The continual legal saga with the repeal of "Don't Ask,
Don't Tell" is beginning to reflect the insanity of a
Roman Polanski film. The Obama administration has
filed papers asking a federal appeals court to reconsider
an order from last week ruling that DADT was no longer
enforceable worldwide. The order from the 9th Circuit
Court of Appeals called for an immediate halt to the policy.
Our gay & lesbian military must feel slapped in the face by
this new development. Veteran & Servicemembers Legal
Defense Network (SLDN) Executive Director Aubrey Sarvis
stated, “At SLDN, we are frustrated by this last-minute filing,
which could well add more delay & confusion for service
members. This development only serves to underscore the
need for immediate certification & finality.”
Remember despite the President signed the bill authorizing
the repeal of DADT, it is still unsafe for service members to
come out until 60 days after certification by the President,
Secretary Panetta & Admiral Mullen. Updates to Come…:)
