Catholic Gay Discrimination Case
In Massachusetts there will be a court hearing on December 1st addressing the firing of Matthew Barrett who was offered & accepted the job of food services manager in July 2014 by Fontbonne Academy a Catholic girls’ preparatory school in Milton, MA. Two days later the offer was rescinded after Barret filled in an employment form listing his emergency contact as his husband, Ed Suplee. Barrett is represented by GLAD (Gay & Lesbian Advocates & Defenders). Ben Klein, GLAD Senior Staff Attorney who is litigating the case stated, “Religiously affiliated entities do not have a free pass to do as they please in how they treat employees, particularly when it comes to our important laws against discrimination. When Fontbonne Academy fired Matt from a job that has nothing to do with religion, they came down on the wrong side of the law.” Matthew Barrett added, “If I’m planning & making meals for students, I’m not sure what my being gay has to do with the job. I’ve always done well in my work & was excited about working at Fontbonne. All I did was fill out the form honestly.” In Barrett v. Fontbonne Academy the complaint alleges that with its termination of Barrett’s employment, Fontbonne Academy discriminated against him based on his sex & sexual orientation which violates the Commonwealth’s non-discrimination law. Barrett, who was born & raised in a Catholic family, lives in Dorchester with his husband & has worked in the food services industry for 20 years in positions of increasing responsibility, at restaurants, with corporate catering services & in public schools. Barrett v. Fontbonne Academy will have its first court hearing on Tuesday, December 1st at 3:30P in Norfolk Superior Court in Dedham, Massachusetts.

Transgender Housing Protections
The U.S. Department of Housing & Urban Development (HUD) has announced proposed rules overseeing housing that is federally assisted or insured which would clarify non-discrimination protections for transgender & gender non-conforming people. Rea Carey, National LGBTQ Task Force Executive Director stated, “LGBTQ people & especially LGBTQ people of color, disproportionately experience discrimination in accessing housing & shelter programs & services. In fact, one in five transgender & gender non-conforming people have experienced homelessness—according to the National Transgender Discrimination Survey report. The rates are much higher among black transgender people & Latino/a transgender people, of whom 41 percent & 29 percent report experiencing homelessness, respectively. While transgender & gender non-conforming youth represent less than one percent of the general population, a recent study found that 6.8% of youth experiencing homelessness identify as transgender or gender non-conforming. We welcome HUD Secretary Julian Castro’s announcement about an essential policy that will help reduce the experience of discrimination against transgender & gender non-conforming people in HUD programs by clarifying how transgender & gender non-conforming people should be accommodated in shelters & other HUD programs. Notably, the rule explains that discrimination protections apply to people based on actual or perceived gender identity, which includes a person’s ‘appearance, behavior, expression, other gender-related characteristics, or sex assigned to the individual at birth.’ For transgender & gender non-conforming people who are experiencing homelessness or housing instability, these changes are much needed. We look forward to collaborating with HUD on ensuring that the implementation of this amendment is as robust as possible.”

Boston Trans Day of Remembrance
Transgender Day of Remembrance is November 20th honoring the memory of those whose lives were lost in acts of anti-transgender violence. Our LGBT community sadly acknowledges so many senseless untimely deaths of our transgender brothers & sisters murdered in 2015 just for being gender nonconforming individuals. This is also Transgender Awareness Week. In Boston there will be a screening of the documentary TRANSFORME, an investigation into the lives of four transgender teenagers. It shows the lives of Alex, Dan, Luna & Piper sharing their personal stories about coming out & the difficulties & triumphs they faced throughout the process. A panel discussion on trans youth will follow the screening. The panel will be moderated by Maxwell Ng, Chair of the Massachusetts Transgender Political Coalition (MTPC) a group dedicated to ending discrimination on the basis of gender identity & gender expression. Currently MTPC is working on legislation to protect trans people in public accommodations. The event takes place at Fenway Health, 1340 Boylston Street in Boston on Saturday, November 21st starting at 10:30A. This year in Boston Transgender Day of Remembrance (TDOR) will be celebrated on Sunday, November 22nd, starting at 4P at St Paul’s Cathedral at 138 Tremont Street in Boston. Boston Pride is a co-sponsor of the event & invites everyone to attend & to show your support for our transgender community. The event is followed by a Potluck Reception at 6:30P

Transgender Congressional Forum
The Congressional LGBT Equality Caucus hosted a landmark forum addressing issues of violence against our transgender community. Members of Congress heard testimony from survivors of violence, community organizers, advocates & policy experts including Jean Tobin, Policy Director of the National Center for Transgender Equality. Tobin stated, “This year when strangers learn what I do for a living, they often say something like, ‘you must be very pleased with how this year is going.’ They are of course referring to the tremendous increase in public awareness we have seen in the last few years. People certainly are seeing & hearing more about trans people than ever before. We are making real progress both in public policy & in shifting the cultural conversation from one of fear & derision to one of understanding & support. But the truth is, that for most transgender people, this year has also been deeply traumatic. Our humanity is being attacked by state legislators, school boards & even Presidential candidates. We are being impugned as deceptive, unstable, or worse, as predators & child molesters, all for political purposes. While we have known for years that trans people face higher rates of suicides, when a transgender person dies by suicide now it is more widely reported than ever before, with so many publicly reported suicides & others lost to suicide who we may never know about…” This was a timely forum gearing up for Transgender Day of Remembrance which is Friday November 20th honoring the memory of those whose lives were lost in acts of anti-transgender violence.

Boston Gay Men’s Chorus Holiday
Boston Gay Men’s Chorus is presenting Ho Ho Ho a holiday concert of traditional carols, including a fabulous new work by the composer Laura Karpman & the world premiere of Forbidden Holiday, a revue of sassy send-ups of seasonal standards from the creator of the Off-Broadway sensation Forbidden Broadway. BGMC Music Director stated, “Boston Gay Men’s Chorus holiday concerts are beloved for blending traditional Christmas carols & Hanukkah music with over-the-top numbers, reflecting both the contemplative spirit & joyousness of the season. Audiences will be treated to stirring renditions of ‘Son of Maria’ & ‘In Dulci Jubilo’ along with the jolly frivolity of tunes like ‘The Christmas Can-Can’ & ‘Pink Christmas.’” Ho Ho Ho will showcase the world premiere of Forbidden Holiday by local composer Gerard Alessandri, the openly gay creator of Forbidden Broadway, an award-winning Off-Broadway roast of current Broadway musicals. LGBT Mormon Resignation Event
The extremely homophobic anti gay Mormon Church has declared a major but not so shocking decree that LGBT Mormons & their families in gay & lesbian relationships are now apostates & their children cannot be baptized without separating themselves from their parents. Kate Kendal the Executive Director of the National Center for Lesbian Rights has announced she is leaving the Mormon Church stating, "It is impossible for me to be a part of a religion that would attack its own members & punish them by denying their children involvement in the church. The move is as clever as it is draconian. Members seeking to live lives of integrity as openly LGBT people must not only leave the church, but take their children with them. It requires a particular streak of evil genius to manufacture such a Sophie’s Choice.” On Saturday November 14th at 1P MST there will be a Mass LGBT Resignation From Mormonism Event at City Creek Park in Salt Lake City, Utah. Over 1000 Mormons in Salt Lake City have signed up on Facebook to participate in a march around the Church's Temple Square & mail letters of resignation to the LDS Church to formally leave the church in protest of its attack on LGBT families. There will be 4-5 testimonials speakers at the park while people who need to get their letters together & then the letters will be deposited in a mailbox near the church office.

Equality Florida To Honor Bonauto
Attorney Mary Bonauto, the architect of gay & lesbian marriage in this country & who successfully argued for marriage equality before the U.S. Supreme Court earlier this year, will be honored in Sarasota later this month with a Lifetime Achievement Award from Equality Florida at its annual Suncoast Celebration. The event will take place Saturday Nov. 21st from 5P to 7:30P under the stars on the roof of the Palm Avenue Parking Garage at 1289 N Palm Avenue in Sarasota, Florida. Michael Donald Edwards the producing artistic director of Asolo Repertory Theatre will also be honored with the Voice for Equality Award. Ken Shelin, Co-chair of Equality Florida’s state board of directors stated, “Our honorees represent the best kind of leadership within the LGBT community. Mary Bonauto has successfully advocated for LGBT families & individuals for more than 25 years. Her legal victories have brought dignity & security to countless Americans. On the cultural side Michael Donald Edwards has helped us understand the humanity of all people, including LGBT people. Our strength & determination could not have happened without people like him.” Bonauto’s first marriage equality case was argued in Vermont in the late 1990s which resulted in granting civil unions in 2000. Then in Massachusetts, Bonauto led the GLAD legal team breaking down the separate-but-equal idea that convinced that state’s Supreme Court in 2003 to declare that gay & lesbian couples could not be denied the legal benefits of marriage. Gay & lesbian marriages began on May 17th 2004 & three years later, the Massachusetts Legislature refused to allow any challenge to the ruling. For Info & Tix: eqfl.org

Restore Gay Veterans Benefits
At a press conference on Capitol Hill, U.S. Senator Brian Schatz (D-Hawaii), Representatives Mark Pocan (D-WI) Charles Rangel (D-N.Y.) & Members of the LGBT Equality Caucus have urged the passage of the Restore Honor to Service Members Act. This legislation would help service members discharged solely due to their sexual orientation correct their military records to reflect their honorable service & reinstate the benefits they earned. Rep. Pocan, Co-chair of the Congressional LGBT Equality Caucus stated, “As we approach Veterans Day, it’s important to remember the sacrifices our veterans have made for our country. This includes the selfless service of more than 100,000 veterans who were discharged from the military because of their sexual orientation. Our legislation ensures that gay veterans who served our country no longer live with tarnished records that prohibit them from receiving the recognition, benefits & honors they deserve.” Rep. Rangel added, "As a veteran, I know that our men & women in uniform give all to serve our country with great honor. We can no longer delay honoring these veterans who deserve long overdue recognition. We struck down ‘Don’t Ask, Don’t Tell’ & legalized gay & lesbian marriage. Love is not dishonorable." Iraq & Afghanistan Veterans of America, VoteVets.org, OutServe-SLDN, the Human Rights Campaign, American Veterans for Equal Rights, Lambda Legal, Swords to Plowshares, the American Bar Association, Universal Unitarian Association & the American Humanist Association support this legislation.

LGBT Rights Loss In Houston
Once again we have the majority voting away the rights of a minority & in this case our LGBT community in Houston, Texas. The Houston Equal Rights Ordinance (HERO) had passed the City Council with the support of our pro-equality allies last year before being forced on the ballot by the all-elected Texas Supreme Court. Then the anti LGBT homophobes in Houston shamelessly & successfully spread misinformation & ugly lies about LGBT people in an effort to prey on voters' fears & distract them from the critical non-discrimination protections HERO provides. Laura E. Durso, Center for American Progress Director of the LGBT Research & Communications stated, “While there is no denying that this result is a loss for the people of Houston, including the city’s LGBT residents who only sought to be treated fairly, this vote also underscores the urgent need for federal action to provide clear, explicit & equal protections from discrimination for LGBT people nationwide. Despite the results in Houston, an overwhelming majority of Americans, including majorities of every race, religion & political party support LGBT-inclusive nondiscrimination laws. Most Americans already think these protections exist nationwide & when the public is educated about the legal patchwork & reality of discrimination faced by LGBT families, the demand for action becomes unstoppable. After the passage of these laws in hundreds of cities across the country & in 19 states, the momentum is evident. If the LGBT community’s historic success with marriage equality tells us anything, it is that, in the long run, misinformation, negativity & fear are always overwhelmed by optimism, hope, & above all love.” Shame On Houston…

LGBT Refugees In America
Recently the U.S. Department of State changed their guidelines that makes it easier for LGBT refugees & asylum seekers to have their partners join them in the United States. The State Department officially changed the interpretation of the term spouse under the Process Priorities, or P-3, family reunification program in order to allow gay & lesbian partners of qualified refugees & asylum seekers in the United States to file an affidavit of relationship in order to join their partners in the United States, even if they are not legally married. Many LGBT asylum seekers in the United States are fleeing persecution from their home countries because they are LGBT & unable to marry. Sharita Gruberg, Center for American Progress Senior Policy stated, “The State Department has made a small but important change to its regulations, which will allow for more LGBT asylum seekers to reunite with their families in the United States. Given that so few countries recognize gay & lesbian marriages, the State Department’s former requirement of marriage documents meant that LGBT refugees had to choose between safety & living with the ones they love. Though the policy change is an important step toward equality within the refugee system, it must be expanded from the limited number of countries recognized in the P-3 program.” This is a fabulous step forward for our global LGBT community.
