DOMA Begins to Crumble

UPDATE: Is DOMA Headed to Congress?
Feb 23rd: Congresswoman Tammy Baldwin (D-Wis) stated,
We have one small, but very significant, step in the ultimate
effort to either see the Defense of Marriage Act repealed by
an act of Congress or declared unconstitutional by a court in
the United States. This is progress and I’m delighted with
the Attorney General’s choice.”
President Obama has finally called the Defense of Marriage
Act (DOMA) Section 3 unconstitutional & has called on the
Department of Justice to end its appeal of 2 Boston based
cases. Section 3 of DOMA denies all gay couples 1,138 federal
rights even though they are legally married in their states.
The Obama administration had faced criticism for appealing
the 2 Massachusetts-based challenges to the law where in both
cases were found Section 3 unconstitutional by a Federal Judge.
Time will tell if this will effect all states where gay marriage is
the law or recognize gay marriage. Updates to Come…:)

I welcome the news that the Department of Justice will not be defending the Defense of Marriage Act in two important cases in New England. This represents a real shift in Department of Justice policy and is one step toward the repeal of the Defense of Marriage Act.

Some people wonder what difference this makes. Today in the U.S., there are five states plus the District of Columbia that issue marriage licenses to same-gender couples. That means there are thousands of same-gender couples across the U.S. with valid marriage licenses who are being discriminated against at the national level because of the Defense of Marriage Act.
